These terms cover the Elev8 Arts website and authorized services connected to it. Specific classes, events, artist relationships, transactions, and physical spaces may carry additional terms shown at the relevant doorway.
TERMS AND CONDITIONS
These Terms and Conditions govern your access to elev8arts.com and the public information and authorized services Elev8 Arts makes available through or in connection with the website. By using the site, you agree to these terms and the Privacy Policy. If you do not agree, do not use the site.
Elev8 Arts shares information about artists, classes, events, community programs, support opportunities, products, and related creative activity. A page does not guarantee that a program, item, date, price, instructor, capacity, feature, or transaction is available. Confirm current details before traveling, registering, purchasing, donating, or relying on site information.
You must have legal capacity to agree to these terms. Adults registering a minor represent that they are the minor's parent or legal guardian or have authority to provide the required consent. Age limits and guardian requirements published for a specific class, event, studio, product, or service control over general website information.
If an account or submission system is activated, you agree to provide accurate, current information, protect your credentials, and promptly report suspected unauthorized use. Elev8 Arts may suspend access when reasonably necessary for safety, security, legal compliance, or violation of these terms.
Participation may require waivers, guardian consent, safety equipment, instructor directions, conduct rules, capacity limits, or other offering-specific terms. You are responsible for following posted and verbal safety instructions. Elev8 Arts may deny or end participation when reasonably necessary to protect participants, staff, artists, property, or the public.
The current public site does not activate online checkout, booking, or donations. If a transaction pathway opens, the price, taxes, payment timing, confirmation status, cancellation, rescheduling, refund, shipping, pickup, donation, and other terms shown at that pathway become part of these terms. A request is not confirmed until the authorized system or an authorized Elev8 Arts representative confirms it.
You retain ownership of original material you submit. When you expressly authorize public display, you grant Elev8 Arts a non-exclusive, revocable permission to host, reproduce, format, and display that material for the agreed profile, listing, event, program, promotion, or archival purpose. You represent that you have the rights and permissions needed for material you submit. Separate artist, vendor, consignment, teaching, commission, or payout terms control those relationships when approved.
Except for material owned by participating artists, vendors, licensors, or other identified rights holders, the website design, Elev8 Arts branding, text, graphics, and site content are owned by or licensed to Elev8 Arts and protected by applicable law. You may view and share ordinary links for personal, noncommercial use, but may not copy, sell, scrape, republish, or commercially exploit protected content without permission.
You may not use the site or an Elev8 Arts service unlawfully; impersonate another person; submit malicious code; interfere with security or operation; harvest personal information; attempt unauthorized access; infringe rights; harass or threaten others; misrepresent an affiliation; or use automated systems to extract or exploit content in a manner that creates unreasonable load or violates these terms.
The site may link to maps, social networks, forms, scheduling, payments, ticketing, media, or other third-party services. Those services are controlled by their providers and governed by their own terms and policies. A link does not guarantee or endorse every statement, product, or practice on the destination.
To the fullest extent permitted by law, the website and its content are provided “as is” and “as available.” Elev8 Arts does not warrant uninterrupted operation, error-free content, or that every historical or third-party detail is current. Nothing on the site is professional medical, legal, financial, or safety advice. Nothing in these terms excludes a warranty or right that cannot lawfully be excluded.
To the fullest extent permitted by law, Elev8 Arts and its directors, officers, staff, volunteers, contractors, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from website use. Liability that cannot legally be excluded remains subject to applicable law.
To the extent permitted by law, you agree to defend and hold Elev8 Arts harmless from claims, losses, and reasonable costs arising from your unlawful use of the site, your violation of these terms, or material you submit without required rights or permissions. This does not apply where prohibited by law.
These terms are governed by Colorado law, without regard to conflict-of-law rules. Unless applicable law requires otherwise, disputes relating to the website will be brought in the state or federal courts serving El Paso County, Colorado. Before filing, the parties are encouraged to contact one another and attempt a good-faith resolution.
We may update these terms by posting a revised version and effective date. If a provision is unenforceable, the remaining provisions continue to apply. These terms, the Privacy Policy, the Shipping and Returns Policy, and any offering-specific terms presented through an authorized pathway form the agreement for the applicable service.
SMS TERMS
Elev8 Capture sends service, operational, support, class, event, confirmation, reminder, and follow-up messages that you request or consent to receive from Elev8 Arts. Consent is not a condition of purchasing goods or services. You must be the account holder or have authorization to use the mobile number supplied.
Message frequency depends on your requests and interactions. Message and data rates may apply. Elev8 Arts does not control carrier charges, coverage, delays, or delivery.
Reply STOP to revoke consent and stop further Elev8 Capture messages. You may receive one final confirmation. You may opt in again later through an approved Elev8 Capture method.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, excluding aggregators and providers of the text messaging services. Read the Privacy Policy.
Elev8 Arts may suspend or change the program for security, compliance, maintenance, or operational reasons. Carriers are not liable for delayed or undelivered messages.
